Early Intensive Developmental and Behavioral Intervention (EIDBI) licensing

Provisional licensure for EIDBI agencies

The Minnesota Legislature is requiring all Early Intensive Developmental and Behavioral Intervention (EIDBI) agencies to have a provisional license. This change will not have an immediate impact on existing EIDBI agencies, but it will require agencies to apply for a provisional license when the application is available later this year. This change will also pause enrolling new EIDBI agencies, which will go into effect upon federal approval. The full text of the new laws can be found in Laws of Minnesota 2025, 1st Spec. Sess., chapter 9, article 6.

All current EIDBI agencies must apply for provisional licensure by May 31, 2026. Applications will be available on this page in the coming months. You can sign up for updates by visiting the DHS EIDBI benefits page, clicking the “more information” tab and entering your email address.

In order to apply for provisional licensure, agencies must be enrolled to provide EIDBI services under chapter 256B. DHS is slated to propose comprehensive licensing standards to the legislature by January 1, 2027. Upon approval and implementation of the comprehensive licensing standards, applications for licensure will be open to all interested parties.

Provider Requirements

To provide, bill and receive payment for EIDBI services, a provider must do all of the following:

  • Be enrolled as a Minnesota Health Care Programs (MHCP) provider. Visit our MHCP enrollment page to learn more.
  • Meet all applicable provider qualifications and requirements, including conducting background studies using NETStudy 2.0 as required by state and federal law.
  • An application for provisional licensure will be available later this year and will be sent to current EIDBI agencies.
  • Certain services require that the individual receiving care has a DHS-approved service authorization (SA). The full details for those services are available in this EIDBI billing grid.

Reporting Maltreatment

The DHS Office of Inspector General, Licensing Division is now the lead investigative agency for reports of alleged maltreatment in EIDBI programs. Reports of alleged maltreatment involving a child occurring in an EIDBI program should be reported to DHS Licensing at 651-431-6600. Alleged maltreatment of a youth aged 18-21 occurring in an EIDBI program should be reported to the Minnesota Adult Abuse Reporting Center (MAARC) at 1-844-880-1574.
