Provisional licensure for EIDBI agencies

The Minnesota Legislature is requiring all Early Intensive Developmental and Behavioral Intervention (EIDBI) agencies to have a provisional license. The full text of the new laws can be found in Laws of Minnesota 2025, 1st Spec. Sess., chapter 9, article 6.

The option to apply for a provisional license closed on May 31, 2026. The Department of Human Services (DHS) will notify applicants about the outcome of their application no later than Dec. 31, 2026. DHS has also paused enrolling new EIDBI agencies, effective Nov. 1, 2025. 

DHS will propose comprehensive licensing standards to the legislature by Jan. 1, 2027. After licensing standards are approved and implemented, applications for comprehensive EIDBI licensing will open.

Help us develop comprehensive licensing standards

DHS is now provisionally licensing EIDBI agencies. Under provisional licensing, agencies will follow the standards that previously existed, as well as some basic licensing regulations. In the future, comprehensive licensing will expand and refine standards for EIDBI agencies.

DHS is currently developing those comprehensive standards. To make the best standards possible, staff need feedback from recipients, caregivers, providers, advocates, and more. Provider requirements

To provide, bill and receive payment for EIDBI services, a provider must do all of the following:

  • Be enrolled as a Minnesota Health Care Programs (MHCP) provider. Visit our MHCP enrollment page to learn more.
  • Meet all applicable provider qualifications and requirements, including conducting background studies using NETStudy 2.0  as required by state and federal law.
  • Have applied for a provisional license from DHS Licensing.
  • Follow requirements for services where the individual receiving care has a DHS-approved service authorization (SA). The full details for those services are available in this EIDBI billing grid.

Provisional licensure forms and documents

The provisional license application in the Provider Hub is closed to new agencies. Currently enrolled agencies may apply for licenses for new locations. 

Reporting maltreatment

The DHS Office of Inspector General, Licensing Division is now the lead investigative agency for reports of alleged maltreatment in EIDBI programs. Reports of alleged maltreatment involving a child occurring in an EIDBI program should be reported to DHS Licensing at 651-431-6600. Alleged maltreatment of a youth aged 18 to 21 occurring in an EIDBI program should be reported to the Minnesota Adult Abuse Reporting Center (MAARC) at 1-844-880-1574.
