Insurance Eligibility Change for Former Spouses

2/21/2025 1:12:43 PM

MMB has updated its policy regarding the availability of SEGIP family coverage for former spouses. Starting Feb. 5, 2025 no former spouse will be eligible to remain on SEGIP family coverage following a divorce.

This change does not affect the coverage for the employee or their children.

MMB began directly communicating this policy change to affected employees in early February. If you believe you are affected but have not received a letter or email from MMB, please contact us at segip.mmb@state.mn.us.

Former Spouse Continuation Coverage

A married employee with family coverage under a SEGIP plan must tell MMB if they get a divorce. The former spouse’s coverage on the family plan ends on the last day of the month that the divorce is final.

When MMB receives notice within 60 days of the divorce, the former spouse can continue their coverage through COBRA. This COBRA coverage begins the day after the family coverage ends, so there is no break in coverage. A former spouse who selects COBRA will be billed the COBRA premium each month for single coverage. They may buy this coverage for up to 36 months.

If the employee fails to notify SEGIP of the divorce within 60 days, the former spouse is not eligible to continue coverage through COBRA. In addition, the employee may have to pay extra costs as allowed by state and federal law.

For all divorces occurring on or after Feb. 5, 2025 former spouses will be offered COBRA continuation coverage per state and federal requirements.

For details on changes allowed due to divorce, go to the divorce page in the Change My Coverage section of the website.
