On April 25, 2020, Governor Tim Walz signed /boards/assets/Emergency_Exec_Order_20-46_tcm21-429916.pdfExecutive Order 20-46 which authorizes Out-of-State Healthcare Professionals (this includes LPNS, RNs and APRNs) who hold an active license in good standing, issued by a state of the United States or District of Columbia, to render aid in Minnesota during the declared peacetime emergency (/boards/assets/Emergency_Exec_Order_20-01_tcm21-429921.pdfExecutive Order 20-01). Before rendering any aid in this State, Out-of-State Healthcare Professionals must be engaged with a healthcare system or provider, such as a hospital, clinic, or other healthcare entity.
Highlights of /boards/assets/Emergency_Exec_Order_20-46_tcm21-429916.pdfExecutive Order 20-46 are:
- Executive Order 20-46 applied to LPNs, RNs, and APRNs and allows nurses licensed by another jurisdiction to render aid in Minnesota without a Minnesota nursing license.
- It became effective immediately upon signing. It remains in effect until the peacetime emergency is terminated.
- The nurse must hold an active license in the U.S. or District of Columbia. The license must be in good standing. This Order does not apply to a license issued by a Canadian province.
- When rendering aid in Minnesota, the nurse's out-of-state license has the same force and effect as if issued by Minnesota. The Board of Nursing may revoke the authorization.
- The nurse must be engaged with a healthcare system or provider, such as a hospital, clinic, or other healthcare entity, in Minnesota.
- The employer must verify the nurse is currently licensed. They can do so on the appropriate Board of Nursing website and at Nursys.com.
- The employer must report to the Minnesota Department of Health the number of Out-of-State Healthcare Professionals engaged with their facility, license type and the length of the engagement. That report is to be filed with the Minnesota Department of Health no later than 60 days after termination of the peacetime emergency.
