Grounds for Administrative and Board Action
The Board of Nursing is authorized by Minnesota statutes to take action against the Minnesota license of a registered nurse (RN) or licensed practical nurse (LPN) if:
- the nurse agrees that the Board may take action and signs an agreement for corrective action or a consent order, or
- following a formal hearing, the Board finds that the nurse has violated a statute or rule the Board is empowered to enforce.
Administrative or Board action may only occur if the practice or conduct involved is within the grounds for disciplinary or corrective action listed in one or more of the following:
- The Nurse Practice Act (Minnesota Statutes Section 148.261)
- Statutes which apply to the regulated persons of all licensing boards (Minnesota Statutes Section 214.103)
- Other statutes or rules such as:
- HIV and HBV prevention program (Minnesota Rules Part 6950.1000)
- Health Professionals Services Program (Minnesota Statutes Section 214.31)
- Sexual Exploitation by Psychotherapists (Minnesota Statutes Chapter 604)
- Maltreatment of Vulnerable Adults (Minnesota Statutes Section 626.557 subdivision 3 and Section 626.5572 subdivision 16)
- Failure to comply with tax payment and child support payment laws (Minnesota Statutes Section 270C.72 and Minnesota Statutes Section 214.101)
