Remediation Requests

The Minnesota Office of Cannabis Management (OCM) is charged with ensuring that all cannabis, cannabis products, and hemp-derived products sold in Minnesota are safe to consume and not a risk public health or safety. As part of these efforts, the law requires all products be tested and pass minimum acceptance criteria.  

If the product fails initial testing, the license holder may request approval for its product remediation plan (Minnesota Rules, part 9810.3100, subp. 9) using the Remediation Request Form. Remediation is the process of correcting a nonconforming product so that it aligns with Minnesota’s requirements. Explicit approval from OCM is required before product remediation begins.  

After remediation, the license holder must retest the cannabis products to ensure the contaminant has been removed and that the product is now safe for consumers. If the product passes testing, it can be sold.  

Note: If the initial failing test result is only for total yeast and mold and/or total aerobic microbial content of flower, the product may not require remediation to be released for sale. The office will share a corrective action and preventive action (CAPA) plan form with any license holder whose product meets these criteria. If the CAPA is approved by the office, the product will be released for sale.
