1800- 38034-In the Matter of the Appeal by Pond Early Childhood Family Development Center of the Order to Pay a Fine for Background Study Violation License No. 1076817 (Child Care Center) May 24, 2022- The Judge must recommend dismissal with prejudice as a result of the Department’s failure to appear for the March 31, 2022, hearing under the applicable rule. The Judge lacks authority to do otherwise. If the Judge had discretion, the Department is correct that the Finden analysis is an appropriate analysis to adopt. Under that analysis, however, the Department lacks a meritorious claim. Therefore, the Judge would still recommend dismissal, but on other grounds.
