September 21, 2020 - The Department demonstrated abuse occurred when, on two occasions, Appellants failed to disclose or make available to the Department the recipient health service records or the vendor's financial records as required by Minn. R. 9505.2185 (2019). The Department did not show that this abuse resulted in overpayments. Therefore, the Department did not properly seek to recover overpayments of $681,810.84 for nursing care, $614,982.05 for PCA services, and $696.49 for home care services from Trinity Home Health Care Services. Further, the Department’s sanction of termination of Appellants’ participation in the MHCP is too severe and not supported by the record. Therefore, the Commissioner should RESCIND the notices of overpayment, termination, and withholding issued to Appellants.
