March 4, 2025 - The Department properly issued the APO to Respondent based on Respondent’s failure to attach a radon mitigation system tag to a radon system that Respondent installed on May 23, 2023, in Minneapolis, Minnesota, in violation of Minn. Stat. § 144.4961, subd. 4 (2024). The Department’s assessment of a non-forgivable penalty in the amount of $750 was not unreasonable. Based upon the record here, the Department’s additional upward adjustment of the non-forgivable penalty in the amount of $250 assessed for a repeat violation was unreasonable. Therefore, the Administrative Law Judge respectfully recommends that the Commissioner of Health (Commissioner) should AMEND the APO to reduce the non-forgivable penalty to $750, and otherwise AFFIRM the APO.
