January 21, 2025 - A preponderance of the evidence establishes that Appellant is responsible for maltreatment by physical abuse. The Department did not establish that the maltreatment was serious maltreatment as defined in Minn. Stat. § 245C.02, subd. 18. The finding of maltreatment by physical abuse and additional licensing violations in Appellant’s program establish reasonable cause to revoke her license. The Administrative Law Judge respectfully recommends that the Commissioner RESCIND the finding of serious maltreatment and Appellant’s disqualification. The Commissioner should AFFIRM the maltreatment by physical abuse determination and the revocation of Appellant’s family child care license.
