November 18, 2024 - The Department established by a preponderance of the evidence that Appellant committed abuse in connection with the provision of medical services paid by public assistance. During the period reviewed, Appellant billed more units than were documented. As a result, the Commissioner of Human Services (Commissioner) may recover overpayments of $9.80. The Department also met its burden of proving that it properly issued a fine of $28,816.28, because Appellant repeatedly submitted claims from which required information was missing or incorrect; repeatedly failed to comply with the requirements of the provider agreement that relate to Minnesota Health Care Programs; and repeatedly failed to develop and maintain health service records as required under Minnesota Rules. Appellant was properly suspended from participation in Minnesota Health Care Programs for a period of 24 months for multiple violations of the stipulated provider agreement. In sum, the Commissioner has grounds to AFFIRM the February 8, 2024 Third Amended Notice of Suspension, Monetary Recovery, and Order to Forfeit a Fine.
