5-1800-39441 In the Matter of the SIRS Appeal by Midwest Quality Home Care, Inc.

November 20, 2024 - The Department did not prove there was forgery with respect to recipient, responsible party, or PCA time sheets. Therefore, no monetary recovery for the Department claims based on forgery is appropriate. The Judge respectfully recommends the Commissioner RESCIND the monetary recovery of $212,114.78. Appellant did not proceed with its challenges of other claimed violations for which it was cited, including the sanctions of a $5,000 fine and monetary recovery of $4,485.63. Moreover, those claims included violations of a Stipulated Provider Agreement (SPA), which was a sanction applied as part of a prior Department action. The SPA required a two-year suspension if Appellant failed to meet any of the terms or conditions of the SPA. Therefore, the Judge recommends the Commissioner AFFIRM the sanction of a $5,000 fine, the recovery of $4,485.63, and a suspension pursuant to the SPA.
