November 6, 2024 - The Department established that Cool Air violated 29 C.F.R. § 1926.501(b)(3) on November 8, 2021. The Department further established that the violation was serious and the penalties for the violation were calculated correctly. Cool Air did not show that any affirmative defense shields it from liability for the citation. Accordingly, the citation and penalty resulting from the November 8, 2021, inspection are AFFIRMED.
