September 18, 2024 - The Department established by a preponderance of the evidence that Appellant committed abuse in connection with the provision of medical services paid by public assistance. During the period reviewed, some recipients lacked current care plans; all care plans lacked required elements; some services were unsupported by documentation; some personal care assistance services overlapped with other employment; and more units were billed than were documented. As a result, the Commissioner of the Department of Human Services (Commissioner) may recover overpayments of $100,932.01. For failing to fully document services (required elements in care plans and on time sheets), the Department properly imposed a fine of $1,102.77. The Department also met its burden of proving that it properly issued a fine of $8,697.79, for repeatedly failing to include care plan end dates and refusing to track qualified professional supervision in and out times. In sum, the Commissioner has grounds to AFFIRM the December 14, 2023 Amended Notice of Overpayment.
