September 6, 2024 - A preponderance of the evidence establishes that Respondent violated Minn. Stat. §§ 326B.82, subd. 11(b)(5)(iv) and .84(5) (violating the terms of the 2020 Consent Order and failing to satisfy judgments); §§ 326B.082, subd. 11(b)(9) and .84(15) (financial irresponsibility for failing to satisfy judgments); §§ 326B.082, subd. 11(b)(5)(iv), .84(5) and .805, subd. 5(c) (failing to notify Department of judgments); § 326B.84(7) (failing to pay subcontractors or suppliers); §§ 326B.082, subd. 11(b)(2) and .84(14) (providing false or misleading information to the Department); §§ 326B.082, subd. 11(b)(6) and .84(16) (failing to provide requested information to the Department; and § 326B.082, subd. 11(b)(8), .84(2), and Minn. R. 2891.0040, subp. 1E (fraudulent, deceptive, or dishonest practice). As a result, the Administrative Law Judge respectfully recommends that the Commissioner AMEND the Licensing Order with Penalty dated January 17, 2023, to remove the violation of Minn. Stat. §§ 326B.84(5) and .86, subd. 2 (insurance violation), rescind the additional $30,000 monetary penalty, lift the stay of the $3,000 monetary penalty imposed in the 2020 Consent Order, and revoke Respondent’s residential remodeler license and the qualifying remodeler registration of Siobhan A. Larsen.
