February 20, 2023 - Applicant provided false or misleading information relating to his license application. However, because Applicant met his burden to establish that the physical location of the license would be his primary residence for the entire period of licensure, the Commissioner should not rely on a violation of Minn. Stat. § 245A.03, subd. 7 (2022) as a basis for the denial. Accordingly, the Judge respectfully recommends that the July 26, 2023, Order of License Denial be AFFIRMED, with modification.
