December 29, 2023 - The Judge concludes that Respondents violated the Rules and Permit conditions that comprise Violations 1 through 5. The Judge further finds that an unforgivable penalty of $20,000 is reasonable under the factors set forth in Minn. Stat. § 116.072, subd. 2 (2022). Accordingly, the Judge respectfully recommends that the Commissioner AFFIRM the Administrative Penalty Order in all respects.
