October 13, 2023 - The Department established that Yellow Tree violated 29 C.F.R. § 1926.501(b)(1) on July 8, 2021, 29 C.F.R. § 1926.501(b)(15) on August 31, 2021, and 29 C.F.R. § 1926.1408(a)(2) on August 31, 2021. The Department further established that the penalties for these violations were calculated correctly. The Department failed to establish that Yellow Tree violated fall protection requirements on August 12, 2023. Yellow Tree did not establish that any violation was the result of unpreventable employee misconduct or of vindictive prosecution. Accordingly, the citations and penalties resulting from Inspection Nos. 318167491 and 318169844 are AFFIRMED. The citation and penalty resulting from Inspection No. 318169117 are RESCINDED.
