April 5, 2023 - The Department proved by a preponderance of the evidence that a Mindak employee was exposed to fall hazards in violation of 29 C.F.R. § 1926.501(b)(1). The Department further established that Mindak knew, or should have known, of the violative condition, the citation item was properly classified, and the penalty was appropriately calculated. Respondent failed to prove that the violation was a result of employee misconduct. Therefore, the citation and penalty issued to Respondent on February 5, 2021, is AFFIRMED.
