April 3, 2023 - The Department proved that Appellant consistently violated Minn. Stat. § 256B.0659, subd. 28(a)(2)(ii) (2022) when it failed to include backup staffing plans in PCA care plans for six recipients. As a result, the Commissioner is authorized to fine Appellant up to $500, pursuant to Minn. Stat. § 256B.0659, subd. 28(b) (2022). The Department failed to prove Appellant committed abuse or was improperly paid as a result of any alleged abuse. Therefore, there is no basis for additional sanctions or monetary recovery under Minn. Stat. § 256B.064 (2022).
