January 9, 2023 - The Administrative Law Judge finds that the Department proved by a preponderance of the evidence, that J.H.O. committed maltreatment. The Administrative Law Judge also finds that Department demonstrated reasonable cause to believe the Appellant committed the licensing rule violations set forth in the Amended Order of Revocation and that Appellant failed to prove that she was in full compliance with those laws and rules at the time the department alleges Appellant violated them. Therefore, the Administrative Law Judge respectfully recommends that the Commissioner uphold the maltreatment determination, the licensing violations and the indefinite suspension and revocation of Appellant’s child care license.
