December 16, 2022 - Petitioner has established by a preponderance of the evidence that Dr. Yang erred in applying Mitigating Factor No. 7 (Lengthy Supervision Following Release from Incarceration). Petitioner is entitled to de novo review of his risk level assignment. Upon de novo review, the Administrative Law Judge concludes that Petitioner’s risk to the public warrants an assignment to Risk Level 3. Petitioner’s assignment to Risk Level 2 is, therefore, MODIFIED and Petitioner shall be assigned to a Risk Level 3.
