December 2, 2022 - The Department demonstrated that Respondent violated two different provisions of the Assisted Living Bill of Rights when it failed to properly address a resident’s fall risk and the resident died. Because one of the violations established was maltreatment that contributed to the resident’s death, the Commissioner may properly issue a fine of $5,000. Further, because of this violation, the Commissioner can only issue a single fine totaling $5,000 under Minn. Stat. § 144G.31, subd. 4(b) (2022).
