November 18, 2022 - The Department has shown by a preponderance of the evidence that Appellant submitted claims for payment for personal care assistance and qualified professional (QP) services that were not supported by care plans and timesheets meeting all legal requirements. The Department may recover an overpayment from Appellant related to these services in the amount of $396,397.16. The Department may also require Appellant to sign an SPA. Therefore, the Notice of Overpayment and Stipulated Provider Agreement dated June 19, 2020 (Notice of Overpayment), should be AFFIRMED.
