October 4, 2022 - The Administrative Law Judge respectfully recommends that the Commissioner grant the Facility’s Motion to Dismiss because Minn. Stat. §§ 144G.01-.9999 (2022), does not provide an administrative hearing for the nonrenewal of housing to a resident of an assisted living facility, even if the resident also receives services from the facility. Therefore, the Office of Administrative Hearings lacks jurisdiction to hear the appeal.
