December 30, 2021 - Petitioner has established by a preponderance of the evidence that Dr. Rostberg erred in the scoring of a MnSOST-4.0, upon which the ECRC partially relied in rendering its risk level assignment. Because the ECRC relied, in part, on an erroneous MnSOST-4.0, Petitioner is entitled to de novo review of his risk level assignment. Upon de novo review, the Administrative Law Judge concludes that Petitioner’s risk to the public warrants the highest level of community notification. Petitioner’s assignment to Risk Level 3 is, therefore, AFFIRMED and Petitioner shall remain assigned to a Risk Level 3.
