65-0325-38570-Heather Kirby, Complainant, vs. Jeremy Thornton, Respondent. August 9, 2022- Pursuant to Minn. Stat. § 211A.02, only candidates or committees that receive or make disbursements of more than $750 in a calendar year are required to report. An individual or committee that does not spend or receive contributions of more than $750 in a calendar year is not required to file campaign finance reports under Minn. Stat. §§ 211A.01-.14. Such an individual is also not required to include a disclaimer on campaign material, under Minn. Stat. § 211B.04, subd. 3(b).
Complainant has established prima facie violations of Minn. Stat. § 211B.04 by Respondent. According to the Complaint, the disclaimers on Respondent’s campaign signs lack an address. Therefore, the claimed violation will proceed to a probable cause hearing as ordered above. At the hearing, Respondent will have the opportunity to indicate whether an exception to the disclaimer requirement applies in this case. If Respondent is subject to an exception, then he should be prepared to establish such evidence at the probable cause hearing so that the case may be resolved.
