23-0325-38553- Don Bumgarner, Complainant, vs. Kau Guannu, Respondent. August 4, 2022- The campaign signs promote Respondent’s candidacy and were disseminated to influence voting. Therefore, the signs meet the definition of “campaign material” under Minn. Stat. § 211B.01, subd. 2. As campaign material, the signs must “prominently include” a disclaimer “substantially in the form” provided under Minn. Stat. § 211B.04, unless they meet an exception provided for in the statute.14
According to the Complaint, Respondent’s campaign signs lack required campaign material disclaimers. Complainant has established prima facie violations of Minn. Stat. § 211B.04 by Respondent. Therefore, the claimed violation will proceed to a probable cause hearing as ordered above.
