22-1800-37813-In the Matter of the Appeal by Creative Stars Academy LLC of the Determination of Maltreatment, Failure to Report Maltreatment, Background Study Violation, and Order to Pay a Fine July 22, 2022- Appellant failed to ensure necessary supervision of Child 1 after considering the child’s age, mental ability, physical condition, length of absence, or environment. Appellant was also responsible for the failure to report maltreatment, failure to ensure adequate supervision, failure to maintain a written record of incidents, and failure to create an individual child care plan for a child with special needs. The Department appropriately determined maltreatment with respect to Child 1 and the five licensing violations identified in its Order. The Department did not meet its burden to establish that Appellant committed maltreatment of a second, unidentified child. The Administrative Law Judge respectfully recommends that the order be modified to reflect one maltreatment determination and five licensing violations, and to reduce the amount of the fine to $1,400.
