    5-1100-38295-In the Matter of the Risk Level Determination of Darren T. Dunn July 15, 2022- Because there is a genuine issue of material fact as to whether Dr. Yang correctly scored the MnSOST-4.0, the ECRC’s Motions for Summary Disposition is DENIED. This case shall proceed to an evidentiary hearing on whether the ECRC erred in its risk level determination. As set forth in Minn. Stat. § 244.052, subd. 6(b), at the hearing, Petitioner shall carry the burden of proof to show, by a preponderance of the evidence, that the ECRC’s risk level determination was erroneous.
