June 30, 2022- The May 4, 2022, deposition subpoena issued to Christine Schwinghammer is modified as follows:
a. Ms. Schwinghammer is commanded to appear at the hearing in this matter.
b. Date and Location of Hearing: July 6-July 8, 2022, Time 9:30 a.m.-5:00 p.m., via Microsoft teams. Ms. Schwinghammer shall provide Mr. Noske an email address where she can receive an invitation to the hearing.
2. The May 4, 2022, subpoena for the production of documents issued to Stearns County Human Services is modified as follows:
a. Stearns County Human Services is commanded to provide Mr. Noske the following documents:
i. All case notes and communications, including but not limited to: e-mails and letters with and between Christine Schwinghammer and Rose Ann Brutger, Tabatha Halvorson, Abigayle Thompson, Cody Lingl, or Jeanie Bergstrom, pertaining to the licenses of Rose Ann Brutger or James L. Noske for the Rose Ann Brutger and James L. Noske Adult Foster Care/HCBS (MN DHS License numbers 1045923 and 1069512) between January 1, 2019, and April 28, 2022.
ii. All documents and files in Stearns Country Human Service’s possession pertaining to the licenses of Rose Ann Brutger or James L. Noske for the Rose Ann Brutger and James L. Noske Adult Foster Care/HCBS (MN DHS License numbers 1045923 and 1069512) between January 1, 2019, and April 28, 2022.
5. By the agreement of the parties at the May 23, 2022, prehearing conference, the hearing in this matter will be held remotely via Microsoft Teams on July 6, 7, and 8, 2022. The parties will receive an email invitation and instructions to attend the hearing within the week prior to the hearing, which they must forward to any witnesses they intend to call.
