0330-37967 In the Matter of the Detachment of Certain Real Property from the City of Breezy Point to Ideal Township (MBAU Docket D-634)
June 10, 2022- The Administrative Law Judge concludes that Petitioners have not established that the Subject Parcels are rural in character and not developed for urban residential purposes. To the extent there are undeveloped properties remaining within the Subject Parcels, Petitioners have not established those parcels are not needed for reasonably anticipated future development. Finally, detachment of the Subject Parcels would cause an undue hardship for the City in carrying out the functions of government. As a result of these determinations, the Petition for Detachment is DENIED.
