1800-37221 In the Matter of the SIRS Appeal by The Therapy Place April 1, 2022- This raises the question for the Administrative Law Judge as to whether Appellant meets the definition of “party” for purposes of MEAJA. Thus, the Judge provides the opportunity for the parties to explain why Appellant meets, or does not meet, that definition of “party.” This will ensure an arbitrary or capricious determination is not made on the Application; but rather, a decision which is reasoned on this critical threshold factor.
