1902-36965-electrical-contractor-license-and-master-electrician-license-of-georgie-posey.pdf April 19, 2022-The preponderance of the evidence in the record demonstrates that Respondents conducted their affairs in a manner that demonstrates incompetence, untrustworthiness, or financial irresponsibility, in violation of Minn. Stat. § 326B.082, subd, 11(b)(9). This violation provides the Commissioner with grounds for discipline. Based on the facts in this record and the consideration of the factors under Minn. Stat. § 14.045, subd. 3, the Judge respectfully recommends the Commissioner use her discretion to impose a discipline for the single violation that demonstrates the authority of the agency in enforcing the laws with which it is charged, while providing Respondents the opportunity to build a business in an appropriate fashion and earn the resources necessary to pay back wages and the damages in the January 29, 2020, Compliance Order.
