1902-37020 In the Matter of the Residential-Building-Contractor License of Zaccariah D. Stuart, d/b/a Stuarts Construction May 27, 2021- The Department assessed penalties that total $4,000. The Department contends that the penalties assessed are reasonable and should be affirmed. Pursuant to Minn. Stat. § 326B.082, subd. 14 (2020), the Commissioner is authorized to prepare a plan for the assessment of penalties. The statute further provides that penalties assessed in accordance with the plan shall be presumed reasonable.42 The Commissioner has established a plan. The penalties were assessed by the Commissioner in accordance with the plan and are, therefore, presumed reasonable. Respondent has presented no evidence to create a dispute of fact about the reasonableness of the penalties.
For these reasons, the Administrative Law Judge recommends that the Commissioner grant the Department’s Motion.
