January 7, 2022 - The Administrative Law Judge respectfully recommends that the Commissioner of the Department of Human Services (Commissioner) RESCIND the Amended Notice requiring Appellant to repay $634,303.47 in claimed overpayments, and ISSUE a SECOND AMENDED Notice of Overpayment requiring Appellant to repay an overpayment in the amount of $335,337.92. The Administrative Law Judge respectfully recommends that the Commissioner AFFIRM the requirement that Appellant agree to the Stipulated Provider Agreement presented to it by the Department, without change.
