October 27, 2021 - The Administrative Law Judge concludes that the DNR did not satisfy its burden to establish, by a preponderance of the evidence, that either Appellant placed prohibited fill material into public waters. The Administrative Law Judge respectfully recommends that the Commissioner vacate portions of the restoration orders pertaining to removing, containing, or restoring public waters as a result of purported filling activity. The DNR has established that the small beach area on the Dunkley property constitutes an impermissible excavation under Minn. R. 6115.0200. The Order requiring Mr. Dunkley to restore the excavation of the beach area to match the previous contour of the shoreline should be upheld.
