August 26, 2021 - The Administrative Law Judge concludes that the Department failed to establish that Appellant was properly disqualified. Appellant established that she did not knowingly withhold relevant information from or give false or misleading information to the Commissioner in connection with her application. Further, Appellant did not violate Minn. Stat. § 245C.09, subd. 1 when her daughter did not complete a background study. Upon consideration of the record in its entirety, the denial of Appellant’s application was improper. The Administrative Law Judge respectfully recommends that the Commissioner RESCIND the disqualification and denial of Appellant’s application and GRANT a license.
