August 30, 2021 - The Commissioner had the authority to remand the case because the report was rejected within the time permitted by the Chief Administrative Law Judge. The Department failed to demonstrate errors or abuse occurred which resulted in improper payments to Appellants for services that were not provided, unnecessary, or did not meet recognized professional health care standards. Appellants did admit to errors that resulted in overpayments totaling $2,330.09, which the Commissioner should recover. The Department’s sanction of termination of Appellants’ participation in the MHCP is not supported by the record. Therefore, the Commissioner should RESCIND the notices of overpayment, termination, and withholding issued to Appellants, except for the recovery of $2,330.09 in overpayments.
