August 23, 2021 - The Board did not reply appropriately pursuant to Minn. Stat. § 13.03, subd. 2 (2020) or Minn. Stat. § 13.025 (2020) when it responded to Complainant’s April 16, 2019, data practices request. The Board violated the MGDPA on May 1, 2019, when Ms. Benson stated that there was no document specifically identifying Ms. Benson as the Data Practices Responsible Authority for the Board and the OOLTC. The Board violated the MGDPA on May 1, 2019, when Ms. Benson stated that there was no document identifying anyone as the Data Practices Responsible Authority for the Board and the OOLTC. The Board did not respond either appropriately or in a timely manner to Complainant’s August 2, 2020, data practices request to inspect all data created since April 2019, identifying Ms. Benson as the Responsible Authority and Compliance Official for the Board and the OOLTC. The Board did not respond either appropriately or in a timely manner to Complainant’s August 2, 2020, data practices request to inspect all documents created since April 2019, and maintained by the Board specifically identifying the Responsible Authority and Compliance Official for the Board and the OOLTC. The Board did not respond either appropriately or in a timely manner to Complainant’s February 13, 2021, data practices request to inspect all data created since April 2019, identifying Ms. Benson as the Responsible Authority and Compliance Official for the Board and the OOLTC. There is no evidence to support Complainant’s allegation that she requested to review all data requests addressed to the Responsible Authority and the Compliance Official for the Board and the OOLTC beginning in April 2019, in data practices requests Complainant made on August 2, 2020, and February 13, 2021. Therefore, this allegation is dismissed. The Board responded appropriately but in an untimely manner to Complainant’s February 18, 2021, request for policies of the Board and OOLTC for accessing public data and private data.
