July 21, 2021 - The Department has established that Respondent Loonan failed to cover or ensure coverage of all approved content for an insurance producer continuing education course on ethics held in November 2019, for which he acted as the coordinator and instructor, in violation of Minn. Stat. § 45.33, subd. 1(8). In doing so, Loonan failed to comply with all laws related to course instruction and did not maintain an atmosphere conducive to learning, contrary to Minn. Stat. § 45.32, subd. 4(1), (3). As a coordinator, Loonan failed to assure compliance with all laws related to educational offerings, under Minn. Stat. § 45.31, subds. 1, 3(1), and did not ensure that all areas of curriculum were addressed, as required by Minn. Stat. § 45.31, subd. 3(3). As a course provider, Respondent LLCI is responsible for Loonan’s violations under Minn. Stat. § 45.307, subd. 2. The Department also established that Respondents demonstrated incompetence in connection with their actions related to the course, such that the Department may impose discipline upon Respondents under Minn. Stat. §§ 45.027, subd. 7(a)(4), 60K.43, subd. 1(8).
