July 14, 2021 - The Administrative Law Judge concludes that a preponderance of the evidence establishes that Appellants violated Minn. Stat. § 115.061(a), Minn. R. 7050.0210, subps. 2, 13, and Minn. R. 7020.2225, subps. 1, 7, when they applied liquid manure to fields in a manner that resulted in a discharge of pollution to waters of the state. However, the Administrative Law Judge finds that an unforgivable penalty of $8,500 is unreasonable under the factors set forth in Minn. Stat. § 116.072, subd. 2. Accordingly, the Judge respectfully recommends that the Commissioner AFFIRM the Administrative Penalty Order but AMEND the civil penalty to $5,850, an amount consistent with the gravity of Appellants’ violations and the MPCA’s penalty matrix.
