October 28, 2020 - The Administrative Law Judge concludes that Respondent placed fill below the OHWL of Unnamed Basin #02-520P in violation of Minn. Stat. § 103G.245 (2020) and Minn. R. 6115.0190, subps. 3A and 3F (2019). The fill placed by Respondent is never permissible in a public waters wetland, and Respondent has failed to establish that he should be issued an after-the-fact permit. Accordingly, the Administrative Law Judge respectfully recommends that the Commissioner AFFIRM the October 31, 2018 Restoration Order.
