October 1, 2020 - The Department has established by a preponderance of the evidence that Appellant billed the Minnesota Health Care Plans for more hours than were documented in the recipient’s medical records and was paid for services that were not properly documented in the recipient’s health service records. The evidence proves that Appellant submitted repeated claims from which required information was missing or incorrect; failed to develop and maintain health service records as required by law; and failed to disclose or make available to the Department recipient’s health records to substantiate its bills. Accordingly, Appellant committed abuse in connection with the provision of medical care to a recipient of public assistance. The Commissioner of the Department of Human Services (Commissioner) is, therefore, entitled to seek recovery of the overpayments and the payments made for services not supported by the recipient’s health records in the amount of $138,486.14.
