March 19, 2020 - A preponderance of the evidence establishes that Appellant is responsible for maltreatment of a minor by neglect for failing to protect children in her care from conditions that could seriously endanger their physical or mental health. Specifically, the evidence shows that Appellant allowed her brother, a convicted sex offender and registered predatory offender, to live in her home and have access to female foster children in her custody. As a result of the maltreatment determination, the Department properly rescinded a set-aside of a disqualification previously granted to Appellant in 2014, related to a misdemeanor domestic abuse charge. This disqualification has now expired as a matter of law. Therefore, the issues of whether Appellant’s disqualification should be affirmed and whether the disqualification should be set aside are rendered moot. Notwithstanding the expiration of the disqualification, the evidence establishes that the Department properly rescinded Appellant’s set-aside as a result of the maltreatment determination. Because the evidence supports a finding that Appellant is responsible for maltreatment and committed licensing violations related to that maltreatment determination, a revocation of Appellant’s child foster care license is warranted. The Administrative Law Judge, thus, respectfully recommends that the maltreatment determination and Order of Revocation be AFFIRMED.
