March 12, 2020 - The Department failed to prove by a preponderance of the evidence that a Ran-Dar employee was exposed to fall hazards in violation of 29 C.F.R. § 1926.501(b)(15). The Department, however, did establish that Ran-Dar was a controlling employer and therefore was responsible for the actions of subcontractor employees under the multi-employer worksite doctrine. The Department established that 29 C.F.R § 1926.501(b)(15) applied, and that Ran-Dar knew of the violative conditions. The Department also established that the proposed abatement periods were reasonable, the citation items were properly classified, and the penalties were appropriately calculated. Therefore, the citation issued to Respondent on April 9, 2018, is AFFIRMED.
