70-0900-36646 In the Matter of the Involuntary Discharge/Transfer of B.M., Petitioner, by the Villa at Bryn Mawr, Respondent

March 5, 2020 - The Administrative Law Judge concludes that the Facility proved by a preponderance of the evidence that: (1) B.M. endangered the safety of individuals in the facility; (2) the notice of discharge provided by the Facility complied with federal law; (3) the proposed discharge location was an appropriate location that adequately meets B.M.’s health and safety needs; (4) the Facility’s discharge of B.M. adequately provided for B.M.’s health and safety needs; and (5) the Facility failed to prepare a discharge summary that complies with federal law. Therefore, the Administrative Law Judge recommends that the Commissioner of the Department (Commissioner) DENY the Facility’s current request to discharge B.M.
