10-0900-36192 In the Matter of the Involuntary Discharge/ Transfer of J.L., Petitioner, by Victory Health and Rehabilitation Center

July 29, 2019 - The Administrative Law Judge concludes that the Facility proved by a preponderance of the evidence that J.L. failed to pay for a stay at the Facility. The Administrative Law Judge concludes that the notice of discharge provided by the Facility did not comply with federal law. The Administrative Law Judge also concludes that the Facility failed to prove by a preponderance of the evidence that it prepared a safe and orderly discharge plan of J.L., failed to prepare a sufficient discharge summary that complies with federal law, and, failed to show that the proposed discharge location is an appropriate location that meets J.L.’s health and safety needs. Therefore, the Administrative Law Judge recommends that the Commissioner of the Department (Commissioner) DENY the Facility’s current request to discharge J.L.
