5-1800-35667 In the Matter of the Appeal by Mistie Wellner of the Order of Denial of her Application for a Child Foster Care License

April 17, 2019 - The Department did not properly deny Applicant’s application to provide child foster care under Minn. Stat. § 245A.05(a). Applicant never completed her application because she did not have required background studies completed for herself and two other people living in the household who were over 12 years of age. The Department did not provide Applicant notice of her incomplete application and give her 45 days to resubmit a substantially complete application, pursuant to Minn. Stat. § 245A.04, subd. 1 (2018). Therefore, the Commissioner of the Department of Human Services (Commissioner) should provide Applicant an opportunity to complete her application before making a determination about the license.
