March 20, 2019 - The Administrative Law Judge concludes that Appellant is responsible for maltreatment by neglect of a vulnerable adult on July 14, 2017. As a result, the Administrative Law Judge respectfully recommends that the Commissioner AFFIRM the maltreatment determination. This is the second maltreatment for which Appellant has been found responsible. In 2015, Appellant was found responsible for maltreatment of a minor by Ramsey County. As a result, Appellant is responsible for “recurring maltreatment” in this case and was properly disqualified by the Department. The Administrative Law Judge, therefore, respectfully recommends that the Commissioner AFFIRM Appellant’s disqualification. Finally, because Appellant has failed to prove that he is not a risk of harm to persons served by Department-licensed programs, the Commissioner should DENY Appellant’s request for a set aside.
